Any person, whether natural or juristic, who furnishes Elev8 Automotive (Pty) Ltd ("Elev8 Automotive", "we", "us", "our") with personal information (as defined in section 1 of the Protection of Personal Information Act No. 4 of 2013 ["POPIA"]), whether related to a contractual arrangement with us, a booking or purchase, an enquiry or negotiation pertaining to our products or services, or for any other purpose, does so acknowledging that we will process their personal information and agrees to the terms and conditions of this Privacy Policy.

This Privacy Policy is intended to notify you of how your personal information is collected, used, disclosed to third parties, and destroyed, in compliance with the provisions of POPIA.

If you prefer that we not process your personal information as set out herein, you may elect not to furnish us with your personal information or, if we already possess your personal information, you may request that we stop processing it. However, your election not to authorise us to process your personal information may affect our ability to render a service to you (for example, quoting, booking or carrying out PPF, vinyl wrap, detailing or branding work) or to fulfil our existing obligations to you. We cannot be held liable for any non-performance of an obligation to you resulting from your election not to provide, or authorise the processing of, your personal information.

Information we collect and receive

Personal information processed:

Full names and/or the name of your business;
Identification number and/or registration number of a juristic entity;
Contact number and email address;
Physical and/or delivery address;
Vehicle information (make, model, year, registration/VIN, and condition), relevant to quoting, booking and carrying out customisation and detailing services;
Before-and-after photographs or video of your vehicle taken in connection with PPF, vinyl wrap, detailing or branding work;
Financial and banking/payment details (processed via our third-party payment gateway);
Order, booking and purchase history;
Confidential correspondence; and
Any other pertinent information pertaining to a person or business which may be required by virtue of a contractual relationship currently in existence or contemplated in future.

By furnishing us with your personal information and/or acquiescing to this policy, or if you have already furnished us with your personal information, you acknowledge that the personal information we process, and the purposes for which we process it, is adequate, relevant and not excessive in the circumstances.

How personal information is obtained:

Information provided by you directly, including, among others:
- when you sign up to use our services, request a quote, or make a booking;
- when services are rendered to you (e.g. PPF installation, vinyl wrap, detailing, vehicle branding);
- by completing forms on our website or those provided to you;
- when you enter a competition, promotion, or complete a survey;
- by posting comments or content on our social media pages, or submitting a testimonial or review; or
- when, during correspondence, you provide information directly to us.
Information collected when you use our website, online store or social media platforms, which uses, among others, cookies, web beacons and other technologies which may provide us with:
- log and location information;
- information we infer about you based on your interaction with our products and services;
- device information (for example, the type of device you're using, how you access our platforms, your browser or operating system, and your Internet Protocol ("IP") address).

Purpose for which personal information is processed

We use the information we collect and receive for the following general purposes:

to fulfil any obligations we may have to you under a contractual arrangement, quote, booking or purchase;
to process online orders and payments through our website;
to schedule, carry out and follow up on PPF, vinyl wrap, detailing and vehicle branding services, and to administer related warranties;
to conduct market research or customer surveys;
to provide you with information, products or services you request from us;
to refer you to an appropriate third-party service provider (e.g. a specialist supplier or subcontracted installer);
to communicate with you;
to provide you with support; and
to provide effective advertising (for example, to send you news, special offers and general information about goods, services and events similar to those you have already purchased, booked or enquired about).

How we share the information we collect and receive

We don't sell your personal information to third parties for marketing purposes. We may, however, share your information in the following instances:

we may disclose your personal information to our employees and third-party service providers (other than those to whom we refer you), in relation to the rendering of services (for example, subcontracted installers, material suppliers, our website hosting, e-commerce and payment gateway providers);
we may share non-personally identifiable information with select business partners;
with other parties in response to legal process, or when necessary to conduct or protect our legal rights;
with companies that provide services to us or act on our behalf.

Your rights

You have the right to ask us not to contact you for marketing purposes. You can exercise this right at any time using any of the "opt-out" options we will always provide when communicating with you. We won't send you marketing messages if you tell us not to; however, we will still need to send you service-related messages (for example, booking confirmations, order updates, or warranty communications).

By furnishing us with your personal information and/or acquiescing to this policy, you acknowledge that our website utilises "cookies". Cookies are text files which collect information and data by monitoring your usage of the website. By using cookies, we are able to enhance our website by developing it in a way that facilitates your preferences. You may disable cookies if you prefer, but this will result in access to certain online functions (for example, online checkout or booking) being limited.

We will retain your personal information only for as long as necessary for the purposes set out in this Privacy Policy or to comply with our legal obligations, resolve disputes, administer applicable warranties, or enforce our legal agreements and policies.

While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. We do, however, employ safeguards intended to mitigate the risk of unauthorised access to or disclosure of your information, and we use our best endeavours to protect your personal information by regularly implementing up-to-date technology.

Access to your personal information

We want to make sure that any personal information we hold about you is up to date. If you suspect that your personal information is inaccurate, you can ask us to correct or remove it.

You may at any time request:

confirmation that we hold your personal information;
access to your personal information;
the identities or categories of third parties to whom we have disclosed your personal information; or
that we correct or delete any personal information that is incomplete, misleading, inaccurate, excessive or out of date.
